Acceptance of Terms
By accessing or using Shield (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use Shield.
Description of Service
Shield is a blockchain-based verification system that allows users to create time-limited, attempt-restricted verification links. The Service leverages the Base blockchain network and IPFS for decentralized storage and verification.
Use License
Grant of License
Shield grants you a personal, non-exclusive, non-transferable, limited license to use the Service for your verification needs, subject to these Terms.
License Restrictions
You may not:
- Use the Service for any illegal or unauthorized purpose
- Attempt to compromise the security or integrity of the Service
- Reverse engineer, decompile, or disassemble any aspect of the Service
- Use the Service to transmit viruses, malware, or other harmful code
- Interfere with or disrupt the Service or servers connected to the Service
- Impersonate another person or entity
- Use automated systems (bots, scrapers) without permission
- Violate any applicable laws or regulations
User Responsibilities
Account and Security
- You are responsible for maintaining the confidentiality of verification links you create
- You are responsible for all activities that occur through your use of the Service
- You must notify us immediately of any unauthorized use of your verification links
- You must be at least 13 years old to use the Service
Acceptable Use
You agree to use Shield only for lawful purposes and in accordance with these Terms. You will not use the Service to:
- Violate any local, state, national, or international law
- Harass, abuse, or harm another person
- Transmit fraudulent or misleading information
- Infringe upon the rights of others
- Engage in unauthorized commercial activities
Blockchain and Smart Contracts
Blockchain Nature
You acknowledge and agree that:
- Verification data is recorded on the Base blockchain and is permanent and immutable
- Blockchain transactions cannot be reversed, deleted, or modified once confirmed
- All verification records are publicly visible on the blockchain
- Shield has no control over the blockchain network or its operations
Smart Contract Risks
You understand that:
- Smart contracts are experimental and may contain bugs or vulnerabilities
- Blockchain networks may experience congestion, delays, or failures
- Transaction fees (gas fees) may vary and are subject to network conditions
- Shield is not responsible for blockchain network issues or failures
Service Availability
No Guarantee of Uptime
Shield is provided on an “as is” and “as available” basis. We do not guarantee that:
- The Service will be uninterrupted, timely, or error-free
- Results obtained from the Service will be accurate or reliable
- The quality of the Service will meet your expectations
- Any errors in the Service will be corrected
Maintenance and Updates
We reserve the right to:
- Modify, suspend, or discontinue the Service at any time
- Update or change these Terms without prior notice
- Perform maintenance that may temporarily limit access
Intellectual Property
Shield Ownership
Shield and its original content, features, and functionality are owned by Shield and are protected by international copyright, trademark, and other intellectual property laws.
User Content
By using the Service, you grant Shield a worldwide, non-exclusive, royalty-free license to use, reproduce, and display verification data as necessary to provide the Service.
Privacy and Data
Your use of the Service is also governed by our Privacy Policy. By using Shield, you consent to the data practices described in our Privacy Policy.
Disclaimers
No Warranties
SHIELD IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Warranties of merchantability
- Fitness for a particular purpose
- Non-infringement
- Accuracy or reliability of results
Blockchain Disclaimer
Shield is not responsible for:
- Blockchain network failures or downtime
- Lost or stolen private keys
- Failed transactions
- Network congestion or high transaction fees
- Changes in blockchain protocols or networks
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHIELD SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, data, or business opportunities
- Damages resulting from use or inability to use the Service
- Damages resulting from blockchain network issues
- Any damages exceeding the amount you paid to use Shield (currently $0)
This limitation applies even if Shield has been advised of the possibility of such damages.
Indemnification
You agree to indemnify, defend, and hold harmless Shield, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including legal fees, arising out of:
- Your use or misuse of the Service
- Your violation of these Terms
- Your violation of any rights of another party
- Your violation of any applicable laws or regulations
Termination
We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including:
- Breach of these Terms
- Request by law enforcement
- Unexpected technical issues
- Discontinuation of the Service
Upon termination, your right to use the Service will immediately cease. However, blockchain records are permanent and cannot be deleted.
Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions. Any disputes shall be resolved in the appropriate courts.
Dispute Resolution
Before filing a claim, you agree to try to resolve the dispute informally by contacting us at eliope933@gmail.com.
Arbitration
If informal resolution fails, disputes shall be resolved through binding arbitration, except that you may assert claims in small claims court if they qualify.
Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to this page. Your continued use of Shield after changes constitutes acceptance of the modified Terms.
We will update the “Last Updated” date at the top of these Terms when changes are made.
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Shield regarding the Service and supersede all prior agreements and understandings.
